The European Commission now seems to have identified subject matters it intends to clarify in "Guidelines" regarding the application of Council Directive 2004/113/EC to insurance, in the light of the judgment of the EU Court of Justice (Test Achats) to be drafted and published before year-end. Given the feedback we have received from our various contacts in Brussels, the final version could include provisions along the following lines:
